Tutoring Terms and Conditions

1. Introduction

These Terms & Conditions apply to all private tutoring services provided by Milverton Education. By enrolling in tutoring, the client agrees to be bound by these terms. This agreement is governed by the laws of England and Wales.

2. Booking and Payment

  • Tutoring is booked on an ongoing or sessional basis, as agreed with Milverton Education.
  • Invoices are issued monthly in arrears via our management system, TutorCruncher.
  • Auto-payment is required. Clients must ensure a valid payment method is saved in their TutorCruncher account before tutoring begins.
  • Payment is automatically processed three days after an invoice is issued. Clients are responsible for reviewing invoices during this window.
  • All fees are exclusive of VAT. VAT at the prevailing rate (currently 20%) is charged on services provided to clients based in the United Kingdom. Clients based outside the United Kingdom are not charged UK VAT; such clients are responsible for determining and meeting any tax obligations applicable in their own jurisdiction.

3. Cancellation Policy

Session Cancellations
A minimum of 24 hours' notice is required to cancel or reschedule a session. Sessions cancelled with less than 24 hours' notice will be charged in full. If a student does not attend a scheduled session without prior notice, the full session fee will apply.

Schedule Changes
Requests to change a regular tutoring schedule on an ongoing basis require a minimum of 7 days' notice. All schedule changes are subject to tutor availability and cannot be guaranteed. Where a requested change cannot be accommodated, we will endeavour to make alternative arrangements where possible.

Tutor Cancellations
In the rare event that a tutor needs to cancel a session, we will provide as much notice as possible and work with you to reschedule at a mutually convenient time.

4. Termination

Either party may end an ongoing tutoring engagement by giving 7 days' written notice. Notice may be given by email to hello@milvertoneducation.com.

5. Responsibilities

  • Clients must ensure a suitable environment for online learning — quiet, private, with reliable internet access.
  • Parents or guardians are responsible for overseeing minors and ensuring their punctual attendance.

6. Auto-Payment System via TutorCruncher

  • TutorCruncher securely manages billing and payment. All payment details must be added via the TutorCruncher portal.
  • TutorCruncher is hosted on secure Heroku servers (AWS Dublin) and is ISO27001 and Cyber Essentials Plus certified.
  • Clients agree to the use of TutorCruncher's platform for account management, invoicing, and secure auto-payments.

7. International Clients

  • All clients, regardless of location, are bound by this agreement.
  • Milverton Education may pursue unpaid invoices internationally, including through legal or third-party collection processes.
  • Payment obligations are not waived due to geographic location.

8. Data Protection & Safeguarding

  • Milverton Education complies with GDPR and takes data protection seriously. See our Privacy Policy for details.
  • Online sessions may be recorded for safeguarding and quality assurance purposes. Consent is obtained at the point of onboarding. Clients who do not wish sessions to be recorded should notify us in writing at hello@milvertoneducation.com.

9. Cooling-Off Period

Under the Consumer Contracts Regulations 2013, clients have a statutory right to cancel within 14 days of entering into this agreement. However, by requesting that tutoring begins within this 14-day period, clients acknowledge that this right is waived once the first session has taken place.

10. Limitation of Liability

Milverton Education's liability to clients is limited to the total value of fees paid in the three months preceding any claim. We are not liable for any indirect or consequential losses, including loss of educational opportunity, exam outcomes, or similar. Nothing in these terms limits liability for death, personal injury, or fraud caused by our negligence.

11. Non-Payment and Enforcement

  • Failure to pay an invoice may result in immediate suspension of tutoring services.
  • Milverton Education reserves the right to pursue unpaid fees through legal action or third-party recovery services.
  • Any legal or administrative costs incurred in recovering fees may be added to the client's balance.

12. Complaints

We are committed to resolving any concerns promptly and professionally. If you have a complaint, please contact us in the first instance at hello@milvertoneducation.com. We will acknowledge your complaint within 2 business days and aim to resolve it within 14 days.

13. Amendments

Milverton Education reserves the right to amend these terms with 14 days' notice. Continued use of our services following any amendments constitutes acceptance of the revised terms.

14. Jurisdiction

This agreement is governed by the laws of England and Wales. All disputes shall be subject to the exclusive jurisdiction of the English courts.
